The Promoter is LaCorium Health Australia Pty Limited (ABN: 29 089 285 861) of Level 3, 2A Lord Street, Botany NSW 2019 (The “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions. 1. Entry into the Dermal Therapy ‘Derm-LA’ competition (the “Competition”) is open to all residents of Australia over the age of 18 years, other than the officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, its related bodies corporate or the agencies associated with this Competition, (“Eligibility Criteria”). 2. Competition begins at 00.01 AEDT on Thursday 1st September 2011 and closes at 23:59 AEDT on Wednesday 30th November 2011 (the “Competition Period”). To enter the Competition and be eligible to win, entrants must: (a) the Eligibility Criteria,; (b) purchase 1 unit of either Dermal Therapy Heel Balm 100g, Dermal Therapy Heel Balm 50g, Dermal Therapy Heel-Magic, Dermal Therapy Fungistop, Dermal Therapy Heel Balm 100g GWP Hand Balm, Dermal Therapy Heel Balm 50g GWP Lip Balm from any participating retailers during the Competition Period, (c) answer the following question: “Tell us in 25 words or less why you would like to win a trip to Los Angeles?” (the “Competition Question”); and (d) either: (i) collect an official entry form at the point of purchase (from selected retailers where available), fully complete the entry form and submit the completed entry to “Dermal Therapy Derm-LA Competition” REPLY PAID 84870 PO Box 1422, Bondi Junction, NSW 1355; or (ii) complete an entry online at www.dermaltherapy.com.au/derm-la (consumers) www.dermaltherapy.com.au/derm-la-trade (trade) Proof of purchase required for online entry, in each case before the end of the Competition Period in accordance with paragraph 30. 3. All entries must include the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address (if applicable) and date of birth to be eligible for entry. All entries must be the original, independent creation of the entrant and must not incorporate material which has been previously published. Incomplete entries or those containing copyright material of third parties, pre-used, defamatory or offensive content will be ineligible to win the Prize. It is the entrant’s responsibility to inform the Promoter if their contact details provided change during or after the Competition Period. 4. Only 1 entry per purchase will be permitted. PRIZE 5. There is 1 x Prize in total, valued at $6310. The Prize consists of: (a) a trip for 2 adults to Los Angeles, United States of America including: return economy class airfares from the winner’s nearest State/Territory capital city to Los Angeles with United Airlines, return airport transfers to/from hotel, valued at $3460; (b) 3 nights’ twin share accommodation at the Beverly Wilshire, Beverly Hills, (Maximum Standard – 4 Star), valued at $1850; and (c) $1000 VISA Debit Card – Spending Money, (“the Prize”). 6. The total maximum Prize pool value is 1 x Prize valued at $6310. The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars. 7. The Prize is not transferable or redeemable for cash or other goods or services. The Prize or any element of the Prize cannot be exchanged for any other Prize. The contents of the Prize will be at the Promoter’s sole discretion. The Prize is subject to availability and the terms and conditions of the entities supplying the Prize. The dates and venues selected by entrants can not be changed at a later date. Entrants are advised that accommodation and air travel will be available in the period February-March 2012 only. 8. The Prize winner should contact the Promoter on 1300 55 55 97 or via email at customerservice@ladermahealth.com to redeem the Prize 9. Entrants are advised that the travel undertaken in conjunction with the Prize is subject to Booking Conditions, which are available upon request. Prize travel is subject to availability at the time of booking and entrants are advised of the travel availability period listed in clause 8. Bookings must be made at a minimum of 4 weeks prior to departure. 10. Flights are permitted on United Airlines services only and departures must be from the Prize winner’s nearest capital city (unless otherwise agreed). The Prize winner and their travel companion must travel on the same flights. 11. The Prize must be taken as stated and no compensation will be payable if the Prize winner unable to use the Prize as stated. There can be no changes made to travel arrangements once tickets are issued. The Prize must be booked by 31 December 2011 and travel will be available in the period February-March 2012 only. No extensions will be given. Any unused portions of the Prize will be forfeited. Entrants are advised that there is a period of travel unavailability. 12. Without limiting paragraph 22, the Prize does not include travel insurance, passports, visas, meals, taxes not already included in the price of the ticket, ground transportation or any other cost not specifically stated. It is the responsibility of the Prize winner and their travel companion to obtain all necessary travel documents such as passports, visas etc that are required for travel to the United States of America. It is the responsibility of the Prize winner and their travel companion to ensure that they each hold a valid passport with at least 6 months validity at the time of travel. 13. Compliance with any health or other government requirements is the responsibility of the Prize winner and their travel companion. It is the responsibility of the Prize winner to enquire about local issues and conditions at destinations prior to travel. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including local government, local consular offices and the website of the Australian Department of Foreign Affairs and Trade. 14. If a Prize or any part of a Prize cannot, in the opinion of LaCorium Health Australia, be provided for any reason, then at its discretion LaCorium Health Australia reserves the right to provide an alternative travel prize or part of a prize (including to an alternative destination) to approximately the same value as that part of the prize being replaced. 15. LaCorium Health Australia and its related bodies corporate and their respective officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with the use of any part of the Prize, except for liability which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law). 16. If any act, omission, event or circumstance occurs which is beyond the reasonable control of LaCorium Health Australia and which prevents LaCorium Health Australia from, complying with terms and conditions, LaCorium a Health Australia will not be liable for any failure to perform or delay in performing its obligations. JUDGING AND AWARD OF PRIZE 17. The Competition will be judged on the basis of creativity at the Promoter’s offices, Level 3, 2A Lord Street, Botany NSW 2019 on or about Friday 2nd December 2011 at 3pm (AEDT). Chance plays no part in the selection of the Prize winners. The Prize winner will be notified via phone on Friday 2nd December 2011 at 4pm and their names published on the www.ladermahealth.com website from Monday 5th December 2011. The Prize must be claimed within 7 days of the publication of the Prize winner. 18. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date set out in clause 18, then the Prize will be awarded to the next runner up. A substitute prize will not be offered in lieu of the Prize. The Promoter reserves the right to rejudge the Competition in the event that an entrant, who was initially deemed to be the winner, is unable to satisfy any of these Terms and Conditions. AGE 19. The Competition is only open to entrants who are 18 years of age or over. Entries submitted by entrants under the age of 18 will be ineligible. TRAVEL 20. It is a condition of entry that the Prize winner and their travel companion must be available to travel to and stay at the Beverly Wiltshire, Beverly Hills s within the dates specified by the Promoter in clause 8. 21. All ancillary costs incurred in taking and using the Prize (including, but not limited to meals, mini bar, spending money, insurance and taxes) are the responsibility of the Prize winner and their travel companion. Unless expressly stated as being part of the Prize, all other expenses are the sole responsibility of the Prize winner and their travel companion. 22. The Prize winner is advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize. 23. The Promoter reserves the right to refuse to allow the Prize winner or his or her travel companion to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that the Prize winner or his or her travel companion are not in the mental or physical condition necessary to be able safely to participate in the Prize. GENERAL 24. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered. 25. By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights, including copyright in their entry. Each entrant indemnifies the Promoter in the event that this warranty is false. Entries that are found to have been derived from the work of another party will be considered invalid. The Promoter reserves the right to disqualify any entry it believes breaches any of these conditions. 26. No responsibility will be taken by the Promoter for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning or utilising the Prize. 27. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prize to cancel the Competition or to vary or cancel the award of the Prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion): (a) the Prize winner does not satisfy the Competition entry requirements; or (b) the Promoter cannot conduct the Competition or award the Prize for any reason beyond its control. 28. In the event that the Promoter cancels the Competition or varies or withdraws the Prize it shall not: (a) be liable to any person for any loss or damage (including, without limitation, loss or damage caused by any negligence, or any direct, indirect or consequential loss) arising out of, or in connection with, such cancellation, variation or withdrawal; or (b) be required to conduct the Competition at any other time. 29. No responsibility will be accepted by the Promoter for late, lost or misdirected entries, including those caused by technical malfunction or temporary shutdown of any communication network. All entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for out-dated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates. 30. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into. 31. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law and without limiting the generality of any other provision of these Terms and Conditions, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to direct, indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition. 33. Any costs associated with entering this Competition or claiming Prizes (such as internet service charges and travel expense from the winner’s home to the airport in Australia) are the responsibility of the entrant. 33. All entry details and any copyright subsisting in the entries become, and remain, the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy which can be obtained by calling 1300 55 55 97. By entering the Competition, the Prize winner agrees, on their own behalf and on behalf of their travel companion, to the use of their names, images, entry response, audio-visual recording and/or photograph/s, without compensation, and agrees that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s.
